The ConstructIQ™ website, platform, intelligence products and related deliverables (collectively, the "Services") are provided by DRS Capital PB, LLC, a Florida limited liability company, doing business as ConstructIQ™ ("ConstructIQ", "we", "us"). DRS Capital PB, LLC is a wholly owned subsidiary of DRS Family Holdings, LLC, a Wyoming limited liability company.
Your agreement is with DRS Capital PB, LLC. You are not contracting with DRS Family Holdings, LLC or any other affiliate, except to the extent this agreement is later assigned under section 15.
By accessing or using the Services, or by purchasing any ConstructIQ product, you ("Client", "you") agree to be bound by these Terms of Service. If you do not agree, do not use the Services.
ConstructIQ provides business-development intelligence, market research, opportunity identification, decision-maker and relationship intelligence, and related deliverables (including the Revenue Intelligence Brief™) to clients across a range of industries. Services are provided on a subscription, mandate, or one-time engagement basis.
Specific products are sold under product-specific Order Terms, which set out price, billing, term and commitment. Order Terms currently published:
Where applicable Order Terms conflict with these Terms of Service, the Order Terms govern for that purchase. These Terms of Service govern in all other respects.
Payments for ConstructIQ are processed by Stripe. Prices are stated in US dollars. Applicable amounts, billing frequency and term are set out at checkout and in the relevant Order Terms.

Where a purchase requires acceptance of these Terms and the applicable Order Terms, acceptance is collected at checkout as an affirmative, unchecked-by-default confirmation. Payment cannot be completed until acceptance is given. ConstructIQ records the accepted document version and the date and time of acceptance.
Subject to payment, ConstructIQ grants you a non-exclusive, non-transferable licence to use ConstructIQ deliverables solely for your own internal business purposes.
You may not:
ConstructIQ retains all right, title and interest in and to, and nothing in these Terms transfers to you any ownership of:
Purchasing a deliverable does not transfer ownership of the methodology that produced it. You receive only the internal-use rights expressly granted in section 6.
ConstructIQ™, Revenue Intelligence Brief™, Client Blueprint™, Buy Box™, Relationship Path™, ConstructIQ Intelligence Engine™, ConstructIQ Intelligence Score™ and ConstructIQ Intelligence Platform™ are trademarks of ConstructIQ.
ConstructIQ deliverables may be watermarked or otherwise fingerprinted for attribution and security purposes, including to identify the recipient of a particular copy.
ConstructIQ may suspend access to the Services where it has credible evidence of credential sharing outside authorized users, or of unauthorized redistribution of deliverables.
Suspension under this section is a protective measure. It does not by itself terminate your agreement or affect amounts already due.
ConstructIQ does not guarantee project availability, contract award, meeting outcomes, revenue generation, financing, permitting approvals, owner responsiveness, or any other transaction or business outcome. All deliverables are provided for informational and strategic planning purposes.
You are solely responsible for conducting your own due diligence before pursuing, bidding on, contracting for, investing in, or otherwise relying upon any opportunity identified by ConstructIQ.
Project data, contact information, ownership records, estimates, scores and recommendations are compiled from sources believed to be reliable but may be incomplete, outdated, or subject to change without notice. ConstructIQ Intelligence Scores™ are proprietary estimates and are not guarantees of any outcome.
Client information, including Buy Box™ and Client Blueprint™ submissions and business strategy data, is kept confidential and is used solely to produce the contracted deliverables. Client data is not shared with third parties except as required to operate the Services (for example secure cloud storage, payment processing and email delivery). See our Privacy Policy.
To the maximum extent permitted by applicable law, the Services and all deliverables are provided "AS IS" and "AS AVAILABLE", and ConstructIQ disclaims all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Without limiting the foregoing, ConstructIQ does not warrant or guarantee:
ConstructIQ provides intelligence to support your decision-making. You remain responsible for your own diligence, underwriting, legal review, tax review, investment decisions, acquisition decisions and outreach decisions.
Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, ConstructIQ's total aggregate liability arising out of or relating to the Services is limited as follows:
To the maximum extent permitted by applicable law, ConstructIQ is not liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, lost revenue, lost opportunity, loss of goodwill or business interruption, whether or not ConstructIQ was advised of the possibility of such damages.
Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law.
Fees for one-time intelligence products are non-refundable once substantive work on the deliverable has begun. Subscription fees are non-refundable once the applicable service period has begun. Prepaid annual fees are non-refundable after the applicable Initial Term has commenced.
ConstructIQ will nonetheless correct or refund charges in the following cases:
ConstructIQ may assign or transfer this agreement, the applicable Order Terms, and its intellectual-property, payment and other contractual rights and obligations, in whole or in part, without your consent where permitted by applicable law, to:
ConstructIQ will remain responsible for performance until an assignment takes effect, and an assignment does not reduce the rights you have already paid for.
You may not assign or transfer this agreement, in whole or in part, without ConstructIQ's prior written consent, except where assignment cannot lawfully be restricted.
These Terms, the applicable Order Terms, and any dispute arising out of or relating to the Services, the parties' relationship, or any transaction with ConstructIQ are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.
The parties submit to the exclusive jurisdiction of the state courts located in Palm Beach County, Florida, and the United States District Court for the Southern District of Florida, and each party waives any objection to venue or forum in those courts.
The parties will first attempt in good faith to resolve any dispute by direct discussion.
To the extent enforceable under applicable law, each party waives any right to a trial by jury in any proceeding arising out of or relating to these Terms, the applicable Order Terms, or the Services.
To the extent enforceable under applicable law, each party agrees that claims will be brought only in that party's individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding.
ConstructIQ may modify these Terms. Modified Terms are published on this page with a new version number and effective date, and apply to purchases made on or after that effective date. The version you accepted at checkout continues to govern that purchase.
